Who's the malingerer and abuser of the system?
I was last re-injured in August 99 and the 3 times prior,of which I was also off work for over a year by DR's orders. Each time I was forced back to work and each time resulting in more damage to my body.This last time has had to be the most strenuous situation I have ever been in my life of 45 years,with deeming of employment of an occupation that is stated for its high rate of back injuries; then there's employers that refuse to hire due to increase of their WCB premiums as I am "HIGH RISK" employee; to whom the WCB refer me too ? To the Labour Board on grounds of discrimination.
All my life I enjoyed inventing and being creative, with wood, metal or combination of both in many various ways, with electrical , welding and carpentry experience, creating was endless. As I had shown WCB of Alberta; my portable Work station.
My plan was simple to me as I already had a National Retailer interested, basic proto-type built and a Canadian manufacture ready to go on completion and testing of proto-type, all I requested was the means for materials and proper equipment.Since I started the portable work station, I have built many more multi-purpose tools that assist me in my injury; which was(amongst other plans) stated in my business proposal to WCB. WCB then hired The Business Development Bank of Canada to take over my "portable work station", their proposal on my behalf was way out of line,pertaining to my overhead costs and marketing, my calculated cost was at least 50% less and marketing already covered; but I was also given a 45% chance of success rate even though all I had was a rough proto-type. Needless to say this is how the rest started.Later I attempted to gain my own Government grants and financing to manufacture other items such as portable fencing for one, I was unable to gain any assistance due to being under the WCB of Alberta's care. I was informed it was the responsibility of the WCB to assist me in my endeavors, it was at that time I gave up on trying to take over my own life.
I was attempting to get out of the WCB at that time and since, as I already knew I hated dealing with them, from prior experience. The last time I was in WCB's rehabilitation center, I had to force them to put me in a work out program that wasn't causing as much pain and injury. First it was tread mill set at a speed calculated by the length of my legs and arms,speed was to fast and hand rails too low; almost fell on my face, 3 days for pain to subside.Next was a go-no-where bike,with a back and hip injury already, more of I cant do; all this was to raise my heart rate. I recommended climbing stairs , there at least I had a hand rail for stability and at my own pace.Later I requested a leg press instead of squats with a box full of weights,that was refused as well as anything else I wanted to prevent more pain and immobility, all due to the supervisors comment of "who are the trained professionals here". On account of the unnecessary situation I was put in, where I was unable to participate in my program from the physical results of the day before, I was denied benefits for the time I was not participating, for listening to them I received not only pain and immobility but financial penalty as well.
To me it seems as if anything an injured worker wants to do for themselves is prevented, even in their act it states that they are the authority of the claimant, in every way shape and form. If I were to hire a lawyer in a 3rd party law suit that caused my injury, I would need WCB of Alberta's permission to proceed.That is only if they allow it,you and your lawyer become property of the Alberta WCB. If you are successful, monies are not be distributed by the court without the permission of the WCB; which at that time you will receive after all legal costs accrued by the WCB, only 25%.
For any of you that have followed my blog or have read other postings,I am not a "malingerer nor an abuser of the system", but the more I deal with WCB the more I see of false accusations pointed from the very people that are guilty of the those accusations. Who's the malingerer and abuser of the system?
If you read the comment below you will see that WCB employees take great pride in their "LAW" that enables them to commit these crimes and abuses, along with the arrogance , mis-information and belittlement that they utter, just ask any employer what happens when they hire anyone that has had a WCB claim.It is also typical of WCB employees to send the injured back to work into employment that is neither compliant to injury or that the worker is qualified for. The WCB employee is a brain washing tool to the public and a liar and manipulator to the injured.

Easiest way to get out of the WCB system is to GET A JOB! Any job! Don't keep focused on your past occupation. If you are gainfully employed in one manner or another you are much more likely to recover from injury. Check the stats - the longer an injured worker remains on disability, the less likely they are to ever return to work. You have to play an active role in your own recovery, don't just wait for everyone else to do the work for you.
Also there is no way for a label of "high risk" to follow you in your applications to other places of employment. Unless you tell an interviewer that you have been on WCB, they have no right to ask you that. And believe me, WCB doesn't have time to track where you are applying and tell them before you get there all about their claims. Nevermind that legally they are not allowed to tell anyone about your claim details under the Freedom of Information and Privacy Protection Act.
Get your facts straight. Learn how to properly express yourself in writing (ie. check your grammar and spelling, properly structure your paragraphs) and quit with all the conspiracy theories.
Go download yourself a copy of the WCB Act. The act is LEGISLATED by the provincial government. This means it is LAW. The WCB is not part of the government. Believe it or not, their employees are trained to side with the worker if there is not a clear cut decision to be made.
If you think you have been scammed out of money, go review the relevant section of the WCB Act before you go manipulating your own finances. I've navigated the WCB system just fine. All you have to do is follow the rules. Oh, and actually want to go back to work.
Oh my goodness, I don't know how I missed this post on my previous visits to this site but the above comment from "LB in Alberta" had my blood boiling. Clearly, whoever this is, they are an employee of this corrupt, cruel system.
I have to wonder about the character of someone that works for and believes in a system that abuses people. What about those that are unable to work, at any job?
I was a nurse for 20 yrs and despite reporting an unsafe environment that my employer also agreed was unsafe, I was injured. I tried to prevent it, my employer did not act on the lack of safety and now here I am permanently injured.
I absolutely, positively LOVED my job. It was my identity, the only thing I ever wanted to do and I can assure you-Mr or Ms. WCB employee, if I were able, I would return to work in a heartbeat! The reality is, I can not. Wishing, hoping and praying will not help me recover.
I truly hope for your sake, you are NEVER injured on the job, as then you would see for yourself just how horrid the system really is. Simply put, they are nothing more than an insurance company and in my opinion, insurance has absolutely NO place in healthcare or injured worker claims. Their primary goal is to make money, PERIOD. God forbid an injury ever happen to you...but karma is an interesting thing. I'd be really careful about how much you tout the wonderful WCB, because you just may be at their mercy on day as well.

Obviously you haven't suffered a severe injury as you state- GET A JOB - I did exactly what you stated, and due to the FRAUDULENT administration of my injury claim by Case Manager / Adjudicator for WCB my undiagnosed spinal injuries / shoulder injuries WORSENED and now I am CRIPPLED and in SEVERE CHRONIC PAIN;
I have had my career stolen from me by WCB who refused to follow several physicians, specialists, neurosurgeons, recommendations for treatment / rehabilitation;
I have been subjected to Fraud, Negligence, misfeasance, undue risk of injury, breach of duty of care, deliberate indifference, defamation, slander, libel, as well as many other tort laws that were violated in the administration of my injury claim by employees at WCB who could care less about any injured worker or their families or anyone else.
I was a long - haul truck driver who was returned to work on morphine and oxycontin, muscle relaxants, etc. with multiple diagnosed but denied injuries.
Due to the severe pain that resulted from aggravating my injuries I went to Doctor after Doctor begging for help, only to have several Doctors write reports to WCB that I was a malingering faker out to abuse the system.
Without so much as an X-RAY or any diagnostic test;
28 Doctors and 18 months later I finally was diagnosed with a broken back; 45 Doctors and 3 years later my severely mangled /fractured tailbone was diagnosed;
I recently saw my 100 physician and his recommendations have also been denied to me and I am being made to appeal and appeal and appeal;
I have had 15 appeals since 2006 and have had WCB employees divulge my personal health and financial information to people. When I questioned WCB about this I was told they were using me as an EXAMPLE;
I find your post shows the ignorance of Canadians of what is actually happening to vulnerable defenseless injured workers, who have had their lives totally destroyed by WCB.

requests for rehabilitation means, POVERTY

#5. DENIED WCB wage replacement benefits or anything and everything that is requested to help the injured or disabled worker is OUTRIGHT BAD FAITH insurance FRAUD; Medical - Legal Racketeering;

Many websites like WCB Report Files and PUB-MED PROVE beyond a shadow of DOUBT, workers compensation is violating injured and disabled workers rights, with impunity as Governments have given them the right to DISCRIMINATE and HARASS defenseless vulnerable Canadian Citizens;
It's people like you that post STUPID statements that further HARM defenseless injured workers, by the way, HOW WOULD YOU LIKE IT, if it was you that I nearly ran over on the highway due to lack of sleep and all the medications that I was placed on so WCB would not have to treat my injuries or pay some wage replacement benefits.

The crap that came out of LB's face is just that crap. What did you have a sliver and WCB kissed your butt crack???? I am also a long haul truck driver with back and neck complications due to a semi truck crash, a fractured wrist bone, that has not healed properly, so for months I have the use of one hand, these crooks at WCB after filing my file with lies, misinformation, distorted facts have deemed I am totally capable of returning to my job as a long haul driver. One-handed???? Its the right hand, gear shifting hand, require both hands to exit and enter semi, fuel, crack open hood, climb up into back of trailer, wash out trailer before reload produce, never mind the fact that my hands and feet go numb and tingle and ache, Dr. Betsner at Millard said its because of the pain, nothing els, my doc said its a pinched nerve?????? 4 months now no rehab, no income, claim is in appeals, I still have use of one hand, numb fingers and feet, can't sit in a moving truck for more than an hour before puking, and they " DEEMED " me fit and capable!!!!!!! BCH ALBERTA
